In our earlier article we explained that the South Australia (SA) State Government started its policy to impose contributory fees for each school child of 457 visa holders, following Western Australia (WA), New South Wales (NSW) and the Australian Capital Territory (ACT). By January 2018 all 457 visa holders in SA will have to pay the contributory fees for each child in school. Depending on the number of children and your household income, the contributory fees can be in excess of thousands of dollars per year.

A successful internship collaboration with the Australia China Business Council(SA) and University of Adelaide

Recently Work Visa Lawyers had the opportunity to host an intern as part of the internship programme jointly organised by the Australia China Busines Council (ACBC) SA and the University of Adelaide. We received an intern from the University of Adelaide, Alice Zhu and she performed the following for Work Visa Lawyers as part of her internship:

  • provide insights for social media marketing for China
  • help arrange posts to the Work Visa Lawyers Weibo account
  • analyse and suggest Chinese social media engagement strategies for the business to adopt

In addition to the above Alice managed to produce a video on her own which shares the experience and feelings of a Chinese international student in Adelaide. The video showcases some of the tourist attractions in South Australia, including:

South Australia announces School Fees for children of 457 visa holders

The South Australian (SA) State Government has introduced school fees for 457 visa holders starting on 1 January 2017. New 457 visa holders who arrive in South Australia from 1 January 2017 will have to pay school fees for each child attending public schools. You will not be required to pay the school fees if your annual gross household income is $57,000 or lower. 457 visa holders are also charged school fees in Western Australia (WA), New South Wales (NSW) and the Australian Capital Territory (ACT).

Do note that this is only applicable to new 457 visa arrivals in SA from 1 January 2017 onwards. It will be extended to all 457 visa holders on 1 January 2018.

Here are the details about the school fees applicable:

Applicable Fees

$5,100 for each primary school child

$6,100 for each secondary school child

The full amount is applicable to the eldest child, with a 10% discount on the fees for subsequent children in school.

Payments can be made upfront, per semester/term or in regular instalments.

Income Means Testing

Families do not need to pay the full fee if their annual gross income does not exceed the income threshold. The income threshold is calculated as follows:

Family with 1 child - $77,000

Family with 2 children - $87,000

Family with 3 children - $97,000

Each additional child will increase the threshold by $10,000.

So how much do I have to pay if my gross income is above $57,000 but below the threshold?

Since you do not meet the threshold income level, you will only need to pay a percentage of the contribution fees. The percentage is calculated as such:

Family with 1 child – 5% for each $1,000 above $57,000

Family with 2 children – 3.33% for each $1,000 above $57,000

Family with 3 children – 2.5% for each $1,000 above $57,000

Here are some examples provided by the South Australia Department for Education and Child Development:

Example 1

Tomas commences work under a 457 visa arrangement and will be paid a gross income of $67 000 pa. He is accompanied by his wife, who is not in paid work, and their eight-year-old daughter, who is enrolled at the local government primary school. His contribution payable would be calculated as follows:

Step 1: Primary school rate of $5100 is the full contribution rate

Step 2: Gross family income is $67 000

Step 3: Relevant family income threshold at which full fees are payable is $77 000

Step 4: As the gross family income is between $57 000 and $77 000, Tomas will not be required to pay the full contribution rate. His income is $10 000 above the $57 000 limit, so the fee payable will be 10 x 5% x $5100 = $2550.

Example 2

Aisha commences work under a 457 visa arrangement and will be paid a gross income of $61 200 pa. She is accompanied by her husband, who is working part time and earning $20 400 p.a., and their two children. Both children attend government schools; one in secondary school, the other in primary school. The contribution payable would be calculated as follows:

Step 1: The full contribution rate is $6100 + ($5100 x 90%) = $10 690

Step 2: Gross family income, (rounded down to the nearest whole $1,000), is $81 000

Step 3: Relevant family income threshold at which full contribution is payable is $87 000

Step 4: As the gross family income is between $57 000 and $87 000, Aisha will not be required to pay the full contribution fee rate. Her family income is $24 000 above the $57 000 limit, so the fee payable will be 24 x 3.33% x $10 690 = $8 552.

Example 3

Lucinda is a sole parent who commences work under a 457 visa arrangement, and will be paid a gross income of $200 000. She is accompanied by her three children, each of whom attend government schools; one in secondary school, the other two in primary school. The contribution payable would be calculated as follows:

Step 1: The full contribution rate is $6100 + (($5100+ $5100) x 90%) = $15 280.

Step 2: Gross family income is $200 000

Step 3: Relevant family income threshold at which full fees are payable is $97 000

Step 4: As the gross family income is above $97 000, Lucinda will be required to pay the full contribution rate of $15 280.

If you are a permanent resident visa holder there is no need for you to pay the contribution fee. You can contact the Department for Education and Child Development (DECD) if you need further information.

This policy will make South Australia an unattractive destination for 457 visa workers with families. Additionally a SA business which genuinely needs a skilled overseas worker to work in SA will have to provide a higher salary package to compensate for the school fees applicable. Costs to the business will be higher if a South Australian business has to sponsor an overseas worker for a 457 visa.

Another note is that the new school fees for 457 visa holders are very complicated. To assess each individual 457 visa holder’s gross income and family composition to calculate the applicable fees will take time and labour. I would guess that the public cost of administering the school fees may be very high to the SA government.

This may cause more applicants to consider the Regional Sponsored Migration Scheme (RSMS) subclass 187 visa instead of the 457 visa if they are to be sponsored by a South Australian business. Many 457 visa holders may also be pushed to apply for permanent residency via the Employer Nomination Scheme subclass 186 visa or the RSMS visa via the Temporary Transition stream. There is now more incentive to consider the permanent RSMS visa over the temporary 457 visa.

Celebrating Culture! The Philippine Honorary Consul General Inaugral Gala Ball

 

Principal Migration Agent and Lawyer, Chris Johnston attended the Philippine Honorary Consul General of South Australia, Mr Mark McBriarty to attend the inaugural Gala Ball on Friday, 12 February 2016. The gala ball was held at the Adelaide Oval with all proceeds going to the Australian Foundation for Fostering Learning in the Philippines (AFFLIP).

Featuring a 3 course Filipino-inspired menu from the Hill of Grace Restaurant, the evening was filled with good food, entertaining performances and pleasant company. An auction was also held at the gala ball to raise funds for the AFFLIP.

It was a pleasure for Chris to be part of this cultural event. It is a nice reminder for businesses to reach out and be involved with the community, especially in providing support and aid to the needy. On behalf of Work Visa Lawyers, we wish the AFFLIP an outstanding year ahead in meeting its objectives to facilitate learning for the young Filipinos in Mindanao and other parts of the Philippines.

Chris spent time with Migration Institute of Australia (MIA) members German Glico and Teresita Sarmiento. Teresita is an active and important member of the Filipino community. She did a great job in organising a number of tables for the Gala Ball.

Thanks to the Korean Community of SA for a Great Day!

We would like to thank the organisers and volunteers from the South Australian Korean Community for putting together the Korean Culture and Food Festival .

It was great to speak with members of the Korean Community, local politicians and the general public about Australian Visas.

People wanted to know about a range of visas including Partner Visas, 457 visa, skilled visas for accountant and student visas.

We enjoyed the food and performances and look forward to next year.

Immigration SA Releases Occupation List – good for ICT Professionals, Trades and Enrolled Nurses; and other news

 

More news in relation to the Australian migration programme in the new fiscal year! Here is an overview:

  • Immigration SA is the first to release its Occupation Lists for State Sponsorship
  • Amendments to the SOL and the CSOL (Dentists and Urban Planners take note)
  • Austrade becomes a nominator for the SIV programme

Immigration SA releases Occupation List

Immigration South Australia has published their occupation lists and will be accepting applications for state sponsorship on the 6 July 2015. All occupations are now listed as “High Availability” but it is expected that places for popular occupations will be filled up very quickly, especially since no other state or territory has published a new list of occupations for sponsorship. Here is a highlight of the SA occupation list:

  • All ICT occupations are available for sponsorship
  • Registered Nurses (nec), Enrolled Nurses and Mothercraft Nurses are available for sponsorship
  • Mining and Oil & Gas occupations are not on the list
  • Applicants who register 80 points or higher in the Skillselect pool can now access the Supplementary Skilled List

A reminder that Immigration SA now charges for processing a state sponsorship application. Read up in our previous news post about the fees applicable here. There are also updates to the English requirements.

On a separate note ACT (Canberra) will announce their occupation list in August 2015.

Amendments to the Skilled Occupation List (SOL) and Consolidated Skilled Occupation List (CSOL)

There have been amendments to the SOL and CSOL, specifically:

  • Urban & Regional Planners, Dental Specialist and Dentists are removed from the SOL and moved to the CSOL – this means that these occupations now require state sponsorship
  • Panelbeater and Cabinetmaker are removed from the CSOL and moved to the SOL
  • Primary School Teacher is removed from the CSOL

Austrade becomes a Nominator for the Significant Investor Visa (SIV)

In addition to the Australian states and territories Austrade is now a nominator for the SIV programme. The application fee for nomination is A$ 1000 which is significantly higher than other states and territories. However applicants nominated by Austrade will be allowed to settle down in any part of Australia.

Immigration SA is taking the lead in receiving new applications for state sponsorship in the new fiscal year. However the allocation numbers for SA are usually low so expect places to be filled up quickly. You should apply as soon as possible on the 6 July 2015. The new role of Austrade as a SIV nominator is also beneficial for applicants who do not have a preferred location for settlement as they will not be geographically restricted.

Announced Changes from Immigration South Australia

 

Immigration SA has published a list of upcoming changes for the new financial year 2014-15. Here are the pending changes that will come into effect on 1 July 2015:

1) New State Occupation List

Applicants looking for South Australia state sponsorship will have to refer to the new occupation list on 1 July to determine eligibility and additional requirements.

2) New English Requirements

ICT occupations now need to fulfil Proficient English or an overall score of Proficient Plus English.

Engineering occupations will need to meet Competent Plus English or an overall score of Proficient English.

There will also be changes to other occupations so you will need to check the new occupation list to find out occupation-specific requirements.

3) Closure of the Online Application System

The SA application system for the 190 and 489 state sponsorship will be closed at 1 p.m. (Adelaide time) on 30 June 2015. The system will only re-open at 12 p.m. on 1 July 2015. All applications that are saved or submitted WITHOUT PAYMENT will be deleted and you will need to lodge new applications. Applications submitted on 1 July 2015 or after will be subject to new state sponsorship requirements.

It is beneficial that Immigration SA has released a list of changes (although not complete) that will be in effect on 1 July 2015. This serves as a reminder to all who are looking to obtain SA state sponsorship to complete their applications and submit payment before the closure of the system. As there may be a rush for submissions near the closure, you are advised to complete the submission as early as possible before the closure date.

The South Australia Supplementary Skilled List provides more options for State Sponsorship

Immigration SA has announced the South Australian Supplementary Skilled List today which replaces the Graduate List. The Supplementary Skilled List contains 480 occupations, many of which that are not on the State Occupation List. The Supplementary Skilled List allows more occupations and different skilled workers to be sponsored by the South Australian state government. Applicants can access the Supplementary Skilled List if they:

  • graduated from studies in a South Australian education institute with at least one academic year of study
  • worked in a skilled occupation in South Australia for at least 12 months
  • have a immediate family member (permanent resident or Australian citizen) who has resided in South Australia for 12 months or more

You must still meet the state nomination requirements for factors such as age, skills assessment, work experience, English and financial capacity. For further information please visit the Immigration SA website.

Immigration SA announces changes to provide visa options for Vocational, Educational and Training graduates – good news for Enrolled Nurses, Cooks and more

South Australian International Vocational, Education and Training (VET) Graduates now considered for State Nominations

 

Effective from 23 December 2014, Immigration SA is including VET graduates as part of the state sponsorship programme for skilled migration visas subclass 190 and 489.  To be eligible VET graduates of South Australia will need to be:

  • Currently working for 12 months or more in their nominated or closely related occupation in South Australia (minimum 20 hours per week); OR
  • Currently working for 6 months or more in their nominated or closely related occupation in a country region of South Australia (minimum 20 hours per week). The country region must be outside of Greater Adelaide.

The country region of South Australia is defined by postcode and you can explore the country regions on the Immigration SA website here.

What does this mean for you?

The expansion of the graduate list means that there are more opportunities for non-bachelor degree graduates to apply for permanent residence in South Australia.  To find out if the new changes are an opportunity for you, visit the Immigration SA website or contact us via the details below.

Immigration SA makes big changes including extending off-list sponsorship to SA graduates of vocational courses – but only to 30 June 2013!

Immigration SA has announced changes to their off-list sponsorship criteria:

“Changes include: (these apply to applicants living and working in South Australia only)

  • - All international graduates of South Australia will be considered; nomination is no longer restricted to students who graduated within the last six months.
  • - Applicants who have completed a vocational education and training (VET) or higher education qualification in South Australia with a minimum duration of one academic year (or CRICOSregistered for a minimum of 46 weeks).
  • - Students who have completed a PhD or Masters by Research qualification in South Australia, no longer require work experience if they have an IELTS score of 7.5 overall or 7.0 in each band.”

Changes will only apply until 30 June, 2013

Due to the short timeframe, the above changes for the off-list  will be most suitable for persons who already have a full skills assessment in a vocational occupation, such as a Nurseryperson.

IELTS Validity extended from two to three years:

Other changes include that Immigration SA will now accept IELTS results which are three-years-old or less on the state nomination decision date
