Employer Nomination Scheme Visa 186

The Employer Nomination Scheme subclass 186 Visa is popularly referred to as the “ENS visa”. The ENS 186 is an attractive Australian Permanent Resident visa. Australian Employers can nominate skilled workers.

The ENS subclass 186 visa involves a two stage process:

Nomination by an Australian employer
A Subclass 186 visa application by the skilled worker

The three streams

There are three application pathways (streams) for the ENS 186 visa:

Temporary Residence Transition stream — for Temporary Work (Skilled) visa (subclass 457), Temporary Skill Shortage visa (482) or Skills in Demand visa holders who have worked for a sponsoring employer for at least 2 years, meet Vocational English requirements (unless exempt) and do not need a skills assessment.
Direct Entry stream — for applicants with at least 3 years of experience, a positive skills assessment and an occupation on the Core Skills Occupation List (CSOL), who are applying from inside or outside Australia, meet competent English (unless exempt) and meet the skills requirements.
Labour Agreement stream — only for applicants sponsored through a tailored and negotiated labour agreement. The age, skills and English requirements are set out in the labour agreement.

The two stages

Stage 1 — Nomination application by an Australian employer. The employer must offer a genuine position relevant to the business, nominate an occupation on the Consolidated Sponsored Occupations List (CSOL) and demonstrate that the training requirements have been met.

Stage 2 — Visa application. Direct Entry applicants must demonstrate Competent English, hold a current positive skills assessment, have 3 years’ experience in the nominated occupation, meet the qualification requirements, hold any required Australian registration and be under 50 (some exemptions apply). Temporary Residence Transition applicants must have held the 457/482 visa and worked for the same employer for at least 2 of the last 3 years (there are very limited exceptions) and must demonstrate Vocational English.
